Craftgifts.ie Terms and Conditions
These Terms and Conditions govern your use of CraftGifts.ie and purchases made through the CraftGifts.ie online marketplace.
CraftGifts.ie is operated under licence by IPCOM LIMITED, an Irish company with company number 602426 and registered office at MAYNOOTH, CO KILDARE.
CraftGifts.ie provides an online marketplace through which independent sellers offer products for sale. Unless expressly stated otherwise, the contract for the purchase of a product is between the customer and the individual seller identified on the relevant product page, checkout page or order confirmation.
By using CraftGifts.ie or placing an order through the marketplace, you agree to these Terms and Conditions, our Privacy Policy, our Returns, Cancellations and Exchanges Policy and any lawful additional terms displayed by the relevant seller.
A seller's additional terms cannot exclude or restrict any consumer right or remedy that cannot lawfully be excluded or restricted.
1. The CraftGifts.ie Marketplace
CraftGifts.ie provides the technology through which customers can discover products, place orders, make payments and communicate with participating sellers.
Marketplace sellers are independent businesses. They are responsible for the products they list, the accuracy of their product information, acceptance and fulfilment of orders, delivery, customer service and compliance with applicable consumer, product-safety, tax and other legal obligations.
CraftGifts.ie may facilitate payments, communications, cancellations, returns, complaints and refunds. This administrative role does not, by itself, make CraftGifts.ie the seller of a product supplied by an independent marketplace seller.
2. Eligibility and Customer Accounts
You must provide accurate, current and complete information when creating an account or placing an order.
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account. Please notify CraftGifts.ie promptly if you believe that your account has been accessed or used without authorisation.
CraftGifts.ie may suspend or restrict an account where this is reasonably necessary to prevent fraud, misuse, unlawful activity, security risks or material breaches of these Terms.
3. Products and Pricing
Each seller is responsible for the products they list on CraftGifts.ie, including their descriptions, prices, availability, delivery information and applicable taxes.
Prices displayed on the website are the prices applicable when an order is placed, subject to correction of obvious pricing, typographical or listing errors.
Where an obvious error is identified before an order has been accepted, the customer may be invited to place the order at the correct price or to cancel it.
Where payment has already been taken for an order that is not accepted or cannot be fulfilled, the relevant amount will be refunded.
4. Placing an Order and Contract Formation
Placing an order through CraftGifts.ie constitutes an offer by the customer to purchase the selected product from the relevant seller.
An automatic email acknowledging receipt of an order does not necessarily mean that the seller has accepted it. The sales contract is formed when the seller accepts the order, confirms that it is being processed or dispatches the goods, depending on the order process displayed at checkout.
A seller may decline an order for a legitimate reason, including lack of availability, inability to complete requested personalisation, suspected fraud, delivery restrictions or an obvious pricing or listing error.
Where an order is declined after payment has been authorised or collected, the relevant amount will be cancelled or refunded.
5. Payment
Payments are processed using the payment methods offered at checkout. Availability of a particular payment method may vary.
CraftGifts.ie or its payment-service provider may collect payment as agent for the relevant marketplace seller. Payment collected through the marketplace does not alter the identity of the seller responsible for supplying the product.
Orders will normally be processed only after payment has been successfully authorised. Payment transactions may be subject to fraud-prevention, identity-verification and security checks.
6. Product Descriptions and Photographs
Sellers are responsible for ensuring that product descriptions, photographs, dimensions, materials and other listing information are accurate and not misleading.
Handmade and artisan products may contain minor variations in colour, pattern, finish, dimensions or appearance. Such variations may form part of the individual character of a handmade product, provided the goods remain in conformity with the sales contract and their description.
The appearance of colours may also vary between screens. This does not permit a seller to supply goods that materially differ from the agreed description.
Goods supplied to consumers must conform to the sales contract and meet the requirements of applicable Irish consumer law.
7. Product Availability
Products are offered subject to availability. Adding a product to a shopping basket does not reserve it.
If a seller cannot fulfil an accepted order, the customer will be notified as soon as reasonably possible and any payment relating to goods that cannot be supplied will be refunded.
8. Delivery
Delivery methods, charges, restrictions and estimated delivery periods may vary between sellers and products. The applicable information will be displayed on the product page, seller page or during checkout where relevant.
Unless a different delivery period has been agreed, consumer goods must be delivered without undue delay and no later than 30 days after the sales contract is concluded.
Delivery dates and times are estimates unless the seller expressly agrees that delivery by a particular date is essential.
If goods are not delivered within the agreed period, the customer may have the rights provided by applicable consumer law, including the right in appropriate circumstances to require delivery within an additional reasonable period or to terminate the sales contract.
Irish law generally requires delivery within 30 days unless another period has been agreed and provides remedies where delivery does not occur as required.
9. Delivery Address
Customers are responsible for supplying an accurate and complete delivery address and any information reasonably required to complete delivery.
Customers should review their delivery information before submitting an order and contact the seller or CraftGifts.ie promptly if a correction is required.
Where incorrect or incomplete information supplied by the customer causes a failed delivery or additional expense, the seller may recover reasonable additional costs, provided this does not restrict any mandatory consumer right.
10. Risk During Delivery
Where delivery is arranged by the seller, goods generally remain at the seller's risk until the customer, or a person nominated by the customer, takes physical possession of them.
Where the customer independently appoints a carrier that was not proposed by the seller, risk may pass when the goods are delivered to that carrier. This does not affect any rights the customer may have against the carrier.
This reflects section 35 of the Consumer Rights Act 2022.
11. International Orders
Sellers may restrict the countries or regions to which they deliver.
International orders may be subject to customs duties, import taxes, clearance charges or other fees imposed by authorities in the destination country.
Where those charges are not included in the price paid at checkout, they will normally be the responsibility of the recipient, subject to the information supplied before purchase and applicable law.
12. Personalised and Custom-Made Products
Some products sold through CraftGifts.ie are personalised, commissioned or manufactured to a customer's individual specifications.
Customers are responsible for checking the accuracy of names, dates, wording, photographs, dimensions and other personalisation information before submitting an order.
Sellers may refuse personalisation content that is unlawful, defamatory, discriminatory, obscene, threatening, infringing or otherwise inappropriate.
The statutory change-of-mind cancellation right may not apply to non-prefabricated goods made on the basis of the customer's individual choice or decision, or to goods that are clearly personalised. This exclusion does not remove the customer's rights where goods are faulty, damaged, incorrect or do not conform to the contract.
13. Returns, Cancellations and Refunds
Consumers may have a statutory right to cancel eligible distance purchases, normally within 14 days, without giving a reason.

Customers also have separate statutory remedies where goods are faulty, damaged, incorrect or otherwise do not conform to the sales contract.

Nothing in these Terms excludes or restricts any consumer right or remedy that cannot lawfully be excluded or restricted.
14. Marketplace Sellers
Sellers using CraftGifts.ie are independent traders responsible for fulfilling their orders and complying with all legal obligations applicable to their products and businesses.
The identity and contact information of the trader responsible for a product will be displayed or made available before the customer is bound by the sales contract, as required by applicable law.
Irish distance-contract rules require prescribed pre-contract information, including the trader's identity, legal identity, address, telephone number and email address, where applicable.
15. Reviews and Customer Content
Customers may submit reviews or other content where that functionality is available.
Reviews must reflect the customer's genuine experience and must not contain unlawful, defamatory, threatening, discriminatory, misleading, infringing or irrelevant material.
CraftGifts.ie may remove or restrict content where reasonably necessary to enforce these Terms, comply with legal obligations or protect customers, sellers or third parties.
16. Acceptable Use
You must not use CraftGifts.ie:
- For unlawful or fraudulent purposes.
- To interfere with the operation or security of the website.
- To introduce malicious software or harmful code.
- To obtain unauthorised access to accounts, systems or information.
- To infringe the intellectual-property or other rights of any person.
- To submit false, misleading, abusive or unlawfully discriminatory material.
17. Intellectual Property
The CraftGifts.ie name, branding, website design, software and content created by CraftGifts.ie are protected by applicable intellectual-property laws.
Product photographs, descriptions, trademarks and other materials supplied by marketplace sellers remain the property and responsibility of their respective owners or licensors.
Website content may not be copied, reproduced, distributed or commercially exploited without the permission of the relevant rights holder, except where permitted by law.
18. Website Availability
CraftGifts.ie aims to keep the marketplace available and functioning correctly but does not guarantee that access will always be uninterrupted or error-free.
Access may occasionally be restricted for maintenance, security, upgrades, technical faults or circumstances outside reasonable control.
Nothing in this section excludes responsibility that cannot lawfully be excluded.
19. Complaints and Disputes
Customers should first raise product or order complaints with the relevant seller through their CraftGifts.ie account or order page.
CraftGifts.ie may assist communications between the customer and seller, but the seller remains responsible for resolving complaints concerning goods supplied under the sales contract.

20. Changes to These Terms
CraftGifts.ie may update these Terms from time to time to reflect changes in the marketplace, legal requirements, technology or business operations.
The Terms applicable to an order will normally be those in force when the order is placed. Material changes will not retrospectively remove rights already acquired under an existing sales contract.
21. Governing Law
These Terms and any non-contractual obligations arising from them are governed by the laws of Ireland.
Nothing in this provision deprives a consumer of any mandatory protection available under the law that applies to them or any right to bring proceedings in a court that has jurisdiction under applicable law.
