These provisions (including the Privacy Policy together with any other documents referred to in these provisions) set out the terms and conditions on which you may make use of the CraftGifts.ie website (the "Site") whether as a seller, guest, or registered user ("Customer Terms").

The Services are operated by IPcom Limited ("we"). We are registered in Ireland.

Access to the Services is permitted on a temporary basis, and we reserve the right to withdraw or amend the services we provide through CraftGifts.ie without notice. We will not be liable if for any reason any of the services are unavailable at any time or for any period.

From time to time, we may restrict access to any or all of the services, to users who have registered with us. Any personal data and other information provided by you is processed by us in accordance with our Privacy Policy. By providing any such personal data or other information, you agree to the terms.

If you choose, or you are provided with, a user identification code, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms.

It is your responsibility to ensure that all information (including your name and address) you upload to CraftGifts.ie is correct and accurate. Ensure that you check all information.

By accessing and using the Site, you are confirming that you are 18 years of age or over.

Intellectual Property Rights

We own, or are the licensee to, all rights, title, and interest in and to the service, including all rights under patent, copyright, trade secret, or trademark law, and any and all other proprietary rights, including all applications, renewals, extensions, and restorations thereof. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse-engineer, disassemble, or otherwise attempt to derive source code from any part of the Service.

You must not extract or otherwise use any of the content on CraftGifts.ie for commercial purposes without obtaining a license to do so from us or our licensors.

We respect the intellectual property rights of others and ask our sellers to do the same. If you are aware that any of your intellectual property rights have been infringed on the site, please contact us.

Description of CraftGifts.ie's Service

When you decide to sell/purchase goods and/or services on CraftGifts.ie, the resulting legal contract is between seller and customer. Such contract shall comprise these terms, the email confirmation of your order, and the applicable details on the product page, and you agree to be bound by all such provisions.

We do not review or control, and are not responsible in any way for, listings provided by Sellers and at no time do we possess any items offered for sale by sellers through CraftGifts.ie.

Disclaimer of Warranties and Limitation of Liability

(a) To the fullest extent permitted by applicable laws, we disclaim responsibility for any harm resulting from your use of any part of CraftGifts.ie.

(b) CraftGifts.ie is provided "as is" and "as available," and we expressly disclaim to the fullest extent permitted by law all express, implied, and statutory warranties.

(d) Nothing in these terms shall limit or exclude our liability for fraudulent misrepresentation, resulting from our negligence or the negligence of our agents or employees, or for any other liability that cannot be limited or excluded by law.

How Contracts Are Formed Between You and Sellers

Each order placed shall be deemed to be an offer by you to sell/purchase the goods and/or services specified within it subject to the terms and the applicable details on the product page.

No order shall be deemed to be accepted by the seller until we (acting as the commercial agent of the Seller) or the seller issues an email acknowledgment of order. The contract between you and a seller will relate only to those goods and/or services notified in the email acknowledgment of order.

Payment Methods

Purchases for goods and/or services between sellers/customers may only be paid for using a debit or credit card through our payment facility (or any other payment method which we may make available from time to time). In accepting or otherwise processing your payments related to the purchase of items from sellers, we act in the capacity as disclosed agent of the Seller.

All prices shall be shown in the applicable currency and payable in that currency.

Refusal of Transaction

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.

Delivery Arrangements

The shopping basket on CraftGifts.ie displays the goods chosen, the seller who shall provide them, and details of postage and packing. The delivery costs for each seller may vary according to the delivery methods they offer. Any delivery times quoted are in working days.

Returns

In the event of returns, a customer will be required to fill out an RMA form. To discuss or organize a return, exchange, or refund of any item, please contact the Seller directly using the contact Seller facility on the Site in accordance with our Returns & Refunds Policy. Any returns or refunds shall be made by the seller.

Links

You may link to the CraftGifts.ie home page or your seller's page on CraftGifts.ie, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

Uploading Material to the Site

Uploaded material must not: (i) be defamatory of any person; (ii) contain material which is obscene, discriminatory, offensive, hateful, threatening, or inflammatory; (iii) infringe any copyright, database right, or trademark of any other person.

Reviews and Ratings

You may leave reviews for a product and rate it using a 1-5 star rating system. Sellers agree they may not place any review for their own products.

Viruses, Hacking, and Other Offenses

You must not misuse CraftGifts.ie or any part of the Service by introducing viruses, Trojans, worms, logic bombs, or other material which is malicious or technologically harmful.

Law and Jurisdiction

Contracts for the purchase of goods or services through CraftGifts.ie shall be governed by Irish law. Any dispute arising from, or related to, such contracts shall be subject to the exclusive jurisdiction of the courts of Ireland.

General comments about CraftGifts.ie are always welcome. Please contact us. If you have any complaints about a particular order, please contact the seller/customer directly. To report any other issue, including an issue with a seller that could not be resolved with them directly, please contact us.

Terms & Conditions of Use – Vendor

Introduction

CraftGifts.ie is a multi-vendor platform designed to provide a space for businesses based in Ireland to sell their products. The platform is provided by craftgifts.ie. By accessing and using this site, you agree to these Terms of Use. If you do not agree, you may not use the site.

Vendor Entity Requirements

• Vendors must be at least 18 years old.
• The business must be based in the Republic of Ireland or Northern Ireland.
• Vendors must provide a short biography or description of their business.

Vendor Obligations

Vendors must:

• Register as a vendor on CraftGifts.ie.
• Provide accurate business contact details.
• Represent their products truthfully and comply with the Sale of Goods and Supply of Services Act.
• Acknowledge and update order statuses promptly.
• Notify CraftGifts.ie when products are shipped and provide tracking details where applicable.
• Respond to customer inquiries within 24 hours in a professional manner.
• Complete all purchases through the website.
• Adhere to buyer terms of sale and e-commerce regulations.

Product Upload Requirements

• Vendors can list up to 50 products for free; additional listings require approval.
• Products do not have to be handmade but must be sold by an Irish business.
• Each product must include an original image taken by the vendor. Stock images are not permitted.

Prohibited Products

The following items are not allowed:

• Alcohol or alcohol-based products.
• Tobacco, medical drugs, or drug-related paraphernalia.
• Pornographic material.
• Illegal or banned substances.
• Items promoting violence or discrimination. Violation of these policies may result in account suspension.

Coupons & Discounts

Vendors may offer discounts for multiple product purchases at their discretion via the Vendor Dashboard.

Payments

• Vendors must set up a Stripe account for transactions.
• Payment is processed through Stripe, with applicable fees deducted.
• Vendors are responsible for their VAT obligations.

Fees

• Listing up to 50 products is free.
• A 10% commission applies to all sales (excluding delivery).
• Vendors requiring more than 50 listings must contact CraftGifts.ie for pricing details.

Shipping

• Vendors are responsible for setting and managing shipping costs.
• Accurate shipping timeframes and tracking details (where applicable) must be provided.

Refunds, Returns & Cancellations

• Vendors must create their own refund, return, and cancellation policies.
• Customer support issues will be handled via the Vendor Dashboard.

Vendor Misconduct

Repeated complaints or failure to deliver products may result in account suspension.

Reviews & Testimonials

• Reviews are not moderated by CraftGifts.ie.
• Vendors may enable or disable reviews but do so at their own risk.
• The company may use customer reviews for marketing purposes.

Disclaimer
